These Terms of Service ("Terms") govern your access to and use of DATABUDDIE Recon™ ("Service"), operated by DATABUDDIE LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By registering for, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
DATABUDDIE LLC operates two core platforms: DATABUDDIE Recon, which provides competitive intelligence and market analytics for the travel and tourism industry; and Bar Intelligence, a beverage management SaaS platform for hospitality operators. Our Services aggregate and analyze multiple data sources to deliver actionable insights about visitor activity, market trends, competitive positioning, and operational performance.
Important: All content, reports, data, methodologies, analytical frameworks, and insights provided through the Service ("Materials") are proprietary and confidential information of DATABUDDIE LLC.
By accessing the Materials, you agree to the following restrictions:
You will NOT attempt to reverse engineer, deconstruct, derive, recreate, or identify the underlying data sources, algorithms, methodologies, processes, or analytical frameworks used to produce the Materials. This includes, but is not limited to:
You will NOT use the Materials, or any insights derived therefrom, to develop, enhance, market, or operate a competing product or service. This restriction applies whether you are acting individually, as an employee, contractor, or on behalf of any entity.
You will NOT share, resell, sublicense, publish, or redistribute the Materials to any third party without prior written consent from DATABUDDIE LLC. This includes sharing login credentials, forwarding reports, or making Materials available on any public or private platform.
The Materials are licensed solely for your internal business use. Any use beyond this scope requires a separate written agreement with DATABUDDIE LLC.
You agree to maintain the confidentiality of all Materials and treat them with at least the same degree of care you use to protect your own confidential information, but in no event less than reasonable care.
Warning: Violation of these intellectual property provisions may result in immediate termination of your access and legal action to protect DATABUDDIE's intellectual property rights, including claims for injunctive relief and damages.
When using the Service, you agree to:
We reserve the right to monitor usage of the Service to detect violations of these Terms. We may employ technical measures to identify suspicious activity, including but not limited to rapid access patterns, automated requests, or access from competitor organizations. We may terminate or suspend your access at any time if we reasonably believe you have violated these Terms.
THE SERVICE AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE MATERIALS ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR INVESTMENT OR BUSINESS DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATABUDDIE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR MATERIALS.
You agree to indemnify and hold harmless DATABUDDIE LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the Service.
These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York.
We may modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.
11.1 DATABUDDIE Bar Intelligence may send SMS text messages to the mobile phone number you provide during account registration or through your account Settings. By providing your phone number and enabling SMS notifications, you expressly consent to receive text messages from DATABUDDIE LLC.
11.2 Message types include: account verification codes, operational alerts, inventory reorder reminders, trial and subscription notifications, weekly operational summaries, and system updates.
11.3 Message frequency varies based on your account activity and notification preferences. You may receive up to approximately 20 messages per month depending on usage. Message and data rates may apply.
11.4 DATABUDDIE LLC is not responsible for any charges from your wireless carrier.
11.5 You may opt out at any time by replying STOP to any message or by disabling SMS notifications in your account Settings. Reply HELP for support information. Opt-out requests are processed immediately.

11.7 Your phone number will not be sold, rented, or shared with third parties for marketing purposes.
